Thomas P. Cunningham

Tom Cunningham is a former KSLN partner (1997-2001) and current partner. He focuses on civil and commercial mediation.

Tom brings more than 30 years of valuable knowledge and experience litigating personal injury and insurance coverage cases. In three decades as a litigator, he has worked with many plaintiffs’ attorneys and insurance company representatives to resolve thousands of cases. He has also participated in hundreds of mediations and arbitrations.

In 2023, Tom started his own civil and commercial mediation and arbitration service, Cunningham Mediation, handling complex insurance coverage matters and catastrophic personal injury cases.  Recognizing the potential for growth and impact, he forged a partnership with KSLN, setting the stage for an expansion of his mediation and arbitration offerings.

Tom was admitted to the National Academy of Distinguished Neutrals (https://www.nadn.org/tom-cunningham).  Membership is by invitation only.  To obtain admission, Tom had to meet stringent practice criteria, as well as peer review.  The NADN is limited to professional mediators who are well-established as trusted neutrals among the legal community within their state of practice.  He has also been selected to serve on the 8^th Judicial District Court Roster of ADR Neutrals and is approved to mediate General Civil and Commercial cases throughout the New York State Court system. 

In addition to mediation and arbitration services, Tom actively defends individuals and companies in core areas of practice including automobile and motorcycle accidents; catastrophic injuries; child victims act/sexual abuse; construction defect litigation; contract disputes; insurance coverage disputes; nursing home neglect/abuse; NYS labor law sections 240(1), 241(6), 200; premises liability; product liability; trucking and bus accidents; and wrongful death.

Outside of the courtroom, Tom’s interests include golf, pickleball, and guitar. He was the founder and captain of his Ride for Roswell Team for more than 10 years, as well as a member of the Roswell Park Alliance Foundation Community Advisory for 10 years.
